Indy’s BLOG – Official Inspection

The ‘official inspection’ is due 11:30 and nothing happens. 11:50 the telephone rings. It’s JellyMommy: “JellyHair is already standing for 20 minutes in front!” What? “Why he doesn’t ring? I am here……” The doorbell rings. I see the top of a head in the intercom. “I can’t open the door. You need to come down.” First time we have problems with the door opener. 🙂 Vil goes down to open the front door for JellyHairs.

Its a frosty welcome and first thing JellyHairs needs to say: “Bad communication. ”

We couldn’t agree more, but we planned to stay calm, avoid any conversationand get over with it as fast as possible.

He is exactly the type of person we expected. Not the tallest one, expensive clothing, nice watch, but no real style.

Anyhow, he carries a very expensive camera to document everything.

Indy’s BLOG – Jellyhair demands an “Official Inspection!”

Dear Vil,

We had complains from the neighbors about the following points:

–          Smell of marijuana and smoke of cigarettes.

–          Construction noise

This worried the owner and we decided to plane an official inspection of the house.

Tomorrow we will inspect Dichtershof 51 in Weesp at 01:00 pm.

Please inform us if you are pressed.

Hello JellyHair,

First I need to let you know that I am very surprised that you involved my employer in our conversation.

Please let me know why you did this? I am very upset and I am NOT willing to accept this.

As far as I am concerned this is illegal and a breach of privacy and confidentiality.

I will check and see if you are allowed to do this and think about appropriate actions.

If you have no valid reason or a good explanation, I see this as an attempt to ‘blackmail’ me and this is NOT acceptable.

Second: I am still waiting for the answers to my questions.

I think 10 days is enough to let me know what you did and what I need to pay.

I never said that I don’t want to pay, but you never explained me what I need to pay for

and several requests went unanswered.

Third:

Yes, there was construction noise somewhere in the Dichershof on Sunday, but it was NOT us.

Fourth:

Yes, we had guests and they smoked on the balcony, but NOT inside the flat as agreed in the contract and we adhere to it.

Fifth: 

Hereby I let you know that you are NOT welcome in the flat and that I see any entry 

without my presence and consent as ‘illegal’ and I will inform the authorities.

You will understand that I am not willing to meet with you in my flat alone and that I want to arrange

a witness to be present to make sure nothing goes wrong.

You are welcome to arrange a meeting to a reasonable time, but NOT on such a short notice.

Bottom line: I see the ‘complaint’ and this email as attempt to pressure me and please be informed that

this was not successful. I also see the complaint as NO reason for you to enter my flat without

consent. You already granted a total stranger access to my flat without my knowledge once and this is enough!

I might be wrong in the understanding of the situation, but as far as I am concerned the complaint is no reason to

enter my flat without consent. If I am wrong please let me know the legal base of your actions,

Please let me know your answers and please stop making everything more complicated than needed.

First I want to quote my last email:

I am wondering what you actually did to justify your charges?

Can you please give me an exact list of work you did for me?

As you saw in the beginning I was willing to pay, but after the

whole stress now I am a little bit upset about your attitude and I started

to wonder why I need to pay beforehand.

As you know I arranged everything within the flat to guarantee

a smooth transition from the old tenant to me.

I documented the status of the flat, listed all needed repairs

and cleaned everything.

I also organized all needed repairs and maintenance for the flat

and this all of this is surely your work.

So, please let me ask you again on which base you want to charge me

and for what?

Even you have absolutely no contract with me, I agreed voluntarily to pay the fee. But for now I am not sure if I should, because there was no service from your side so far.

Third

I want let you know that I am very uncomfortable with your way of communicating and behavior. I don’t want to summarize everything again. So just a few points: You granted a stranger access to my flat without my knowledge, then you exaggerated the situation with allegations …… and now you are threatening me?

Bottom line

I am working in customer service myself and I need to say that I would complain to your manager, but you are the owner of your company, so this is no way for me. So I put Magdalena in CC to let her know what’s going on.

Please answer my questions, arrange a handover (and not again 45 minutes before), send me the bill.

Indy’s BLOG – Just Dumped The Phone!

Shit happens, literally! 🙂 Today Vil threw his nice phone in the toilet and killed it.

Vil: “Shit, I just killed my phone! Anyone of you guys have a spare one which you can borrow me for a moment?”

Flatmate one: “Nope!”

Flatmate two: “I do have a phone, but it is locked, you can’t use it with your simcard.”

Vil: “I cold unlock it, no damage done and you can use it later with any network you want.”

Flatmate two” “NO!, I need the phone and don’t ask me for stuff. That’s your problem. I don’t want to be involved in your problems!”

Vil: “Wow, sorry! I was just wondering if a mate could help me out!”

Flatmate two: “We are NO mates! We just know each other, nothing else.”

At that moment we should have realised that the situation is going south, but we couldn’t imagine what to come.

Hello JellyMommy,

I want you to know that I am a bit confused about the content of your last email, it seem that there is a communication issue which lead to some misunderstandings. I don’t want any further escalation and therefor I reread all emails and will summarize the complete communication below.

My first contact with the previous tenant was arranged without your help and we agreed that I will take over the main lease with one remaining and one new sub-let tenant. He informed you about this and I contacted JellyHairs via telephone, asked him about the conditions and send him my details via email 19 February 2018 at 13:15. It was agreed that he will send the new contract to the owner to be signed. He didn’t mentioned any other needed IDs or whatever and I was under the impression that you already got the details from the other two. Also he didn’t said anything about any fees to be paid.

On the 26th of February 2018 at 09:09 I contacted JellyHairs again  and asked for the contract and he told me that it was send to the owner this weekend.

On the 27th February 2018 at 12:24 I received a copy of the contract with the wrong tenants. I remarked that and JellyHairs asked me to send the list of tenants to him. You where obviously not aware of the actual tenants living in the apartment. I arranged that you received the details from the other tenants.

I also asked the following questions.

Question 1: Do you have the contract in English?

This questions was not answered. For me it’s quite irritating that your are not able to supply an English translation and not answered my question.

Question 2: Which additional cost to pay monthly or yearly? Maintenance, Waste, Water or insurance?

I was told to ask the previous tenant. Please correct me if I am wrong, but I deal was with you and not the previous tenant.

Question 3: How to pay the deposit? You already have one part of the deposit?

Answer: Will make the calculation for you after check-in

Question 4: How to pay the monthly rent? Everyone by himself or all via me?

Answer: Via You.

Question 5: Which additional papers I need to register at the Gemeente?

Contract.

Question 6: Who is the actual owner? Is he living next door? I dont understand the address.

Address is the same but lives out of the Netherlands.

Question 7; Anything else you need?

NO!

Also again no mentioning of a service fee to be paid.

Just to let you know:

Alfred and I arranged the move for Thursday. The Other One will supply us with the keys.

… I also Informed JellyHairs that we arranged to move and we need the keys and want to keep them. No comment from his side.

28 February 2018 at 13:23 I confirmed ID to be sent.

28 February 2018 at 14:53 you send me an email to meet JellyHairs at 15:30 at the flat and understandable I was not able to meet him on such very short notice. You remember, that I lived in City Centre at that time and to pop over would need more than 45 minutes anyway. I responded 28 February 2018 at 15:14.

28 February 2018 at 20:00 I asked the counts of Gas, Water and Electricity to be noted in the contract and you didn’t replied to this request and I understood that all is sorted now and we are ready to move in.

1 March 2018 at 11:56 You send me a bill for the deposit and administrative fees and told me that we need to pay this immediately or we can’t move in. I send the never mentioned service fee without any complaint.

1 March 2018 at 12:09 The money was send I informed you via email that I am already on the move and asked JellyHairs to be there to arrange everything. I also informed that we need the keys and JellyHairs just took a pair with him. Unfortunately, I send the fee to the landlords account, but that shouldn’t be any issue.

After this I called you and informed you that there is a confusion with the deposit from The Other One, because he already paid it. I also informed you that JellyHairs already agreed to sort the deposit out after we moved in. At that time I still thought that there will be no further issue.

1 March 2018 at 15:28 I called JellyMommy and later I summarized our conversation via email, but you never responded and confirmed our agreement.

Yes, you informed me that there will be a cleaner coming, BUT you didn’t arrange any date with me and she just showed up unannounced, WITH keys to the flat. You will surely understand that this in very irritating to me. Anyhow, I asked her to come in and she cleaned a little bit limestone on the shower, but other than that there was nothing to do anymore, because I cleaned everything already quite a bit.

I want to let you know that I offered the cleaning lady a coffee and asked her nicely to hand over the keys to me. She did that without hesitations or comment, because she understood that this is my flat and I don’t want anyone showing up unannounced with keys. I see this as an intrusion of my privacy. I was aware that someone will come to clean, but again not WHEN. I ask you to respect our privacy and not enter the flat without consent or grant total strangers access.

Anyhow, I overlook the wording ‘intimidating’ in your email, because your English level might not be up to the level that you understand the difference between ‘intimidating’ and ‘inviting’ and just let you know that writing in capital letters, within email communication is considered shouting and I am not willing to accept this kind of attitude from a service provider I pay.

Just to summarize. I paid the requested rent of 1850 Euro and therefor I see our rental agreement as valid. I will list the readings of Gas, Water and Electricity and attach photos as prove.

You never informed beforehand that there is any fee due to pay for your services and I didn’t agree to any fees. Anyhow, I agree to pay after the contract is signed, even I see no basis for your request, because we never had a valid agreement for fees. You will excuse that we send the fee to the wrong account, this was caused by the ‘lack of proper communication’. We will resend the fee after the contract is correctly signed and all is validated.

I kindly request your presence in the flat to sign the contract and document existing damage. Hub, Door, Carpet, Heater Maintenance, .. Also we need to clarify which parts of the storage room contents belongs to the landlord and will remain when we terminate the lease.

Normally I would be a bit more relaxed about this, but I am very irritated about your attitude and I see upcoming problems, so I decided to document all further communication way more exact than needed.

I will send the deposit today and wait for your response to arrange a proper handover. Please let me know when it suits best for you to meet in the flat to document the damage and hand over the contract.

No real invoice,

First time any fees mentioned.

A last call to the Agency to confirm the hand-over.

“Hi there, this is Vil. I just want to confirm that Jellyhair will be present for the hand-over!”

Silence,…. “Did you pay the deposit and the rent?”

“Nope, you need to pay before!”

Vil is a bit confused: “I do have an agreement with Jellyhair that we arrange the deposit and the first rent after we moved in, because there is a previous flatmate who stays and it’s not clear who needs to pay what.”
